1. Agreement
These Terms of Service form an agreement between you and Exam Reviews, an independently operated tutoring and exam-preparation service based in Ottawa, Ontario, Canada. By using the website, submitting a booking, or purchasing a service, you agree to these terms and our Privacy Policy and Refund Policy.
If you do not have legal capacity to enter this agreement, a parent or legal guardian must make the purchase and agree on your behalf.
2. Educational services
Exam Reviews provides independent tutoring, course reviews, learning materials, and exam-preparation services. We are not affiliated with, endorsed by, or acting for any university, college, instructor, publisher, or examination body unless expressly stated.
Educational outcomes depend on many factors. We do not guarantee a grade, result, admission, academic credit, or mastery of particular material. You remain responsible for your studies, submissions, academic decisions, and compliance with your institution’s rules.
3. Academic integrity
Our services are for lawful learning and exam preparation. You must not use the website, a session, or any supplied material to cheat, impersonate another person, complete a prohibited graded assessment, evade academic rules, or infringe another person’s rights. We may refuse or end a service where we reasonably believe it would facilitate academic misconduct.
You are responsible for confirming what assistance, materials, calculators, software, collaboration, or artificial intelligence tools your institution permits.
4. Booking information and communications
You must provide accurate contact, course, participant, and scheduling information. You are responsible for reviewing the service, price, currency, tax, participants, and selected times before paying, and for keeping your email address and private booking links secure.
We may send transactional emails needed to administer the service, including payment, booking, Microsoft Teams, materials, schedule-change, cancellation, and refund messages. Delivery times can be affected by email providers and other systems outside our control.
5. Prices, tax, and payment
Prices are shown before checkout in the applicable currency. Canadian purchases may be subject to HST or other applicable tax. Stripe processes card payments. Your booking is not confirmed until payment succeeds and our system records the booking as paid.
You authorize the one-time charge shown at checkout. If a price or service description contains an obvious error, we may cancel the affected transaction and issue a full refund rather than provide the service on incorrect terms.
6. Scheduling and attendance
Sessions take place at the dates and times shown in your confirmation, normally through Microsoft Teams. Unless the booking page expressly states otherwise, times use the America/Toronto timezone (Eastern Time). You are responsible for joining on time with a compatible device, adequate internet connection, and any materials reasonably required for the session.
A late arrival does not extend the scheduled end time. If you cannot attend, use the private management link in your confirmation or contact us as early as possible. Rescheduling, cancellation, missed-session, and refund rules are described in the Refund Policy.
7. Course reviews, packages, and learning workspaces
A multi-session package is purchased as one service. Unless we agree otherwise, cancellation applies to the complete package and the applicable cutoff is measured from its first scheduled session.
Private workspaces and download links are issued only to the purchasing student or authorized participant. They may expire or be disabled after the service has been completed or where misuse is suspected.
Simulated assessments are practice materials, not official examinations. Assignment of a particular assessment may be recorded so that a later purchase for the same course can use a different available assessment.
8. Materials and intellectual property
The website, session content, assessments, solutions, recordings supplied by us, and learning materials are owned by Exam Reviews or used with permission and are protected by intellectual-property laws. Subject to payment and these terms, you receive a limited, personal, non-exclusive, non-transferable licence to use supplied materials for your own studies.
You may not sell, publish, upload, share, reproduce in bulk, distribute, record, or commercially exploit a session or supplied material without prior written permission. You must not remove notices or use materials to create or train a competing product or service.
You retain ownership of files you submit. You give us permission to store, copy, view, and use those files only as reasonably needed to provide, secure, and administer your purchased service. You confirm that you have the right to provide them.
9. Acceptable use
You must not interfere with the website; bypass access controls; probe for vulnerabilities; misuse private links; scrape or automate access without permission; upload malware or unlawful content; harass another participant; or use the service in a way that could harm Exam Reviews, its providers, or another person.
We may suspend access, remove submitted content, or cancel a booking for serious or repeated violations. Any refund in those circumstances will be determined under applicable law and the nature of the unused service.
10. Third-party services
The service relies on providers such as Stripe, Microsoft, Apple, internet carriers, and hosting services. Their services are governed by their own terms and privacy practices. We are not responsible for an outage or act of a third-party provider beyond our reasonable control, but we will make reasonable efforts to restore, reschedule, or otherwise address an affected Exam Reviews service.
11. Availability and changes
We may update the website, catalogue, prices, availability, instructors, delivery methods, or future services. Changes do not alter a confirmed purchase unless you agree or the change is reasonably necessary. If we cannot provide a material part of a paid service, the remedies in our Refund Policy apply.
12. Disclaimers and liability
To the extent permitted by law, the website and educational services are provided on an “as available” basis without warranties beyond those expressly stated or imposed by law. Nothing in these terms excludes a warranty, remedy, or liability that cannot lawfully be excluded.
To the extent permitted by law, Exam Reviews is not liable for indirect, incidental, special, or consequential loss, loss of grades or academic opportunity, or loss caused by your device, connection, conduct, or breach of institutional rules. For claims relating to a purchased service, our aggregate liability will not exceed the amount you paid for the affected service, except where a different remedy is required by law.
13. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada applicable there. The courts located in Ontario have jurisdiction, subject to any mandatory consumer right to bring a claim elsewhere.
14. General terms
If one provision is unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver. These terms, the policies linked above, the checkout details, and your confirmation form the agreement for the purchased service. In a conflict, mandatory law applies first, followed by the checkout details for that purchase, these terms, and the general website description.
